This Privacy Policy explains how Marini SkinSolutions ("MSS," "we," “us,” or “our”) may collect, use, process and/or share personal information about you and how you can exercise your privacy rights regarding that information. The Policy applies to persons who access our website www.mariniskinsolutions.com, mobile apps, or social media pages, participate in our programs or marketing activities, or otherwise communicate with us as described in this Notice (the “Services”).

PERSONAL INFORMATION WE COLLECT

         When you use our services, we may collect certain personal information about you.  As used in this Privacy Policy, the term “personal information” has the same meaning given to the term by the California consumer Privacy Act (CCPA). Information that is aggregated, tokenized, or otherwise de-identified, so that it does not identify you as a specific individual, or information that is publicly available, is not “personal information.” 

These are the kinds of information we may collect:

  • Information you voluntarily provide to us. We collect your information when you communicate to us by email; when you sign up for marketing communications or events; when you register for newsletters, alerts or other materials; when you sign up for a webinar or event; when you submit inquiries through our website; when you create an account with us; when you order products; when you submit an application for employment with us; when you respond to our communications or requests for information; or through any other information voluntarily provided by you through any channel.  This information may include your name, contact information, title, information about the organization (if any) with which you are affiliated; or any other information you voluntarily provide to us.  Under such circumstances, we may keep a record of your contact information and may use your email address and any other information you provided to us, to respond to you or to provide the services you requested.

         If you create an online account, we also collect your password as well as      information regarding your interests and preferences. Purchase information      is maintained in account form as required to engage in secure consumer       friendly e-commerce. Unless specifically requested and you use the method        that we identify for such purpose, please do not send us any personal or otherwise confidential information.   (Users may edit or change their    personal information in their account by logging in and following the "edit this information" link in their account.)

  • Information we collect automatically. When you use our services, our servers may also automatically capture information about you, such as, but not limited to:
  • Device Information. the type of browser and operating system you are using, Internet Protocol (IP) address, the domain name of your internet service provider, which pages you visit on our site and how long you spend on each, and the unique number assigned to your server or internet connection.
  • Performance and Log Data. Our servers may automatically record information created by your use of our services, including your IP address, browser type, operating system, command line information, diagnostic information related to the services (for example, crash reports), the referring web page, pages visited, location, your mobile carrier., device and application ID’s, and search terms. For instance, when we send you an email our servers may collect certain information including the nature of the email, whether you opened or deterred it, or your name and contact information.
  • Cookies. We use cookies and website analytics to collect anonymized statistical information about website usage by all of our visitors, to improve our design and functionality and to optimize and customize the shopping experience. Please review our Cookie Notice below for more information or click the “Cookie Settings” link in our website footer (the cookie icon at the bottom right) to update your browser’s cookie preferences for our website at any time.
  • Information We Receive From Third Parties. If you connect with us over a social media network such as Facebook, LinkedIn, or Instagram, our systems may automatically capture personal information from a particular network consistent with your privacy settings there. That information could include your name, user name, user ID, profile photo, age range, friends and/or follower list, etc.  If your privacy settings allow such information to be shared, we will assume that such social network is authorized to share it with us.

HOW AND WHY WE USE YOUR INFORMATION

We do not sell your personal information to third parties. We may occasionally share your information with third party service providers who need your information to work on our behalf. We use your information as follows:

  • To provide our services to you. We use your personal information to inform you of upcoming marketing events, industry developments, product characteristics and recommendations, new products, and other subjects of interest to you based on your contact)s) with us; and to deliver targeted marketing materials to you.

To respond to your inquiries or requests. We pride ourselves on our customer service and product expertise.  When you contact us with questions, comments, or concerns, we will collect your personal information in order to serve you in a manner consistent with our high expectations.

  • To monitor the use of and improve our website. Site visit information is used only in aggregate form to help enhance the overall MSS shopping experience and to personalize customer experience. As previously indicated, we also use cookies and Google Analytics for this purpose.
  • To assist in our marketing efforts.  We provide your contact information to a third party which assists us in sending bulk emails to existing customers.  This contact information includes only your email address. We require that third party to exercise reasonable care to protect your personal information and to adhere to all pertinent privacy laws, and we restrict the use of the information to the purposes for which it was provided.
  • To ensure the Security of the Services. We are committed to your safety and continued enjoyment of our services. In order to fulfill that commitment, we process your personal information to: combat spam, malware, malicious  activities or security risks; improve and enforce our security measures; and to monitor and verify your identity so unauthorized users to not access your account with us or the information we otherwise hold.  We cannot ensure the security of our services if we do not process your personal information for security purposes.
  • To Personalize Your Experience on the Services. As previously indicated, by personalizing the services you can enjoy our services even more because we keep track of your preferences, such as your language preference, time zone, etc. Without processing our personal information for such purposes, you may not be able to access or personalize all or part of our services.
  • For Potential Employment. If you seek employment with us, we process your personal information in order to evaluate you as a candidate for the position you seek.  Without doing so, we cannot evaluate your qualifications or suitability for the position.
  • To comply with valid legal requirements. We may access, preserve, and disclose your information if we believe that doing so is required or appropriate to comply with valid legal requests, to protect your, our, or others’ rights, to enforce our policies or agreements, or to respond to you or at your direction to disclose the information.

 

INFORMATION SHARING AND DISCLOSURE

We do not sell, exchange, transfer or give your personal information to any other company, individual or entity for any reason, except as set forth in this Private Policy and as described below.

  • Service Providers. We may share information with our service providers, subcontractors, and similar third parties who provide services to us or act on our behalf so that they can assist us with our services as described above.  For example, we provide your contact information to a third party which assists us in sending bulk emails to existing customers.  This contact information includes only your email address.   
  • Legal Concerns or Liabilities. We may use, share, or disclose information about you in order to address legal concerns or liabilities, especially when we believe, in our sole discretion, that (a) you may have misused the services, such as to gain unauthorized access to any system, engaged in spamming or other improper activities; (b) disclosure is reasonably necessary to enforce our Terms of Use; (c) to respond to suspected illegal or fraudulent activity; or (d) to protect legal rights or defend against legal claims, and/or to allow us to pursue available remedies or limit the damages we or a third party may sustain.
  • Your Consent. We will disclose your information to a person to whom you have given us your consent to disclose or as required to complete the services.

 

SECURITY

         Protecting your security is very important to us. MSS is a Verisign™ Secure Site. We use secure servers that utilize firewalls to protect your information, as well as the industry standard Secure Socket Layer (SSL) encryption. Unfortunately, no electronic data transmission or storage of information can be guaranteed to be 100% secure. Accordingly, while we employ commercially reasonable security measures to protect the information in our custody, we cannot absolutely guarantee the security of any information we may have collected or received from you, or transmitted to you.  If you have reason to believe that your information is not secure, please notify us immediately by emailing us at privacy@mariniskinsolutions.com or phoning us at (888) 695-2611. 

 

DATA RETENTION

We will retain your information for as long as necessary to provide our services, or where we have an ongoing legitimate business need to do so, such as for legal, regulatory, accounting or reporting requirements.   When our legitimate interest for retaining your personal information cease to exist, we will either delete or anonymize your information so it can no longer be attributed to a particular individual. 

 

INFORMATION PERTAINING TO MINORS

We do not knowingly collect, use or disclose the personal information of individuals under the age of 18.  If we become aware that such an individual is submitting information to us without the consent of his or her parent(s) or legal guardian as permitted under applicable laws, we will delete the information from our database as soon as possible.  If you have reason to believe that we are collecting information about an individual under 16 years of age without parental consent, please notify us immediately at privacy@ mariniskinsolutions.com or phone us at (888) 695 – 2611 so that we can take appropriate action.

 

PRIVACY RIGHTS AND CHOICES

Depending on the applicable law where you reside, you may be able to assert certain rights identified below with respect to your personal information.  Any rights you may have with respect to your personal information are not absolute.  We reserve the right to decline to act on a request that is manifestly unfounded or excessive (such a requests that are repetitive) and/or to charge a fee that takes into account the administrative costs of providing the information or take the action requested. Your potential rights:

  • Right to Know and Access. You may have the right to obtain a copy, or a list of categories, of the personal information we posses about you, as well as other information such as the purposes of using that information and the entities to whom we disclose your personal information.
  • Right to Correct. You may have the right to correct any of your personal information in our records and systems, and may request that we rectify, correct, or update any of that information that is incorrect.
  • Right to Delete. Under certain circumstances you may have the right to request that we delete the personal information that we hold about you. However, this right is not absolute and we may refuse such a request if there are compelling and legitimate grounds for keeping your personal information for legitimate purposes, or as required by law.  In the event your request is granted, we may retain a record of your request to delete information as required under applicable law.
  • Right to Portability. You may have the right to receive a copy of the personal information we have collected about you, in a structured, commonly used and machine-readable format if possible.
  • Right to Appeal. In certain jurisdictions, you may have the right to appeal if we decline to take action on your rights request. Instructions regarding how to appeal will be provided to you upon such a denial, but in any even such instructions will be substantially similar to those provided below for submitting requests.
  • Right Against Discrimination. You may have the right not to be discriminated against for exercising any of the rights described in this section. In any event, we will not discriminate against you for exercising your rights.

We do not sell your personal information, nor do we process any information that may be considered ‘sensitive personal information” under certain laws, to infer characteristics about you.

To make a privacy rights request, please contact us by email at privacy @mariniskinsolutions.com or contact us at (888) 695 – 2611.  In order to confirm your identity, we may ask you to verify personal information we already have on file for you.   If we cannot verify your identity based on that information, we may request additional information, which we will only use to verify your identity, and for security or fraud-prevention purposes.

If you submit such a request, please make clear what information you would like to have changed, whether you would like to have your personal information corrected, deleted, or subjected to other limitations you would like us to put on our use of your personal information. We may only implement requests with respect to personal information that is associated with the particular email address that you use to send your request.

You may use an authorized agent to submit a rights request on your behalf.  If you do, we will require you to directly verify your identity with us, or have you directly confirm with us that the authorized agent has indeed been authorized to act on your behalf.

Depending on the applicable law, access to your rights may be declined: (a) when denial of access is required or authorized by law; (b) when granting access would negatively impact the privacy rights of another person; (c) to protect our own rights and property; or (d) where the request is frivolous, vexatious, harassing, duplicative, or otherwise unreasonably problematic.

 

NOTICE TO CALIFORNIA RESIDENTS

“Personal information” under the California Consumer Privacy Act of 2018 (“CCPA”), as amended by the Consumer Privacy Rights Act of 2020, is defined as any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly with a particular consumer or household (“Personal Information”).

The CCPA requires us to explain the “Personal Information” categories that we collect, the reasons we collect the Personal Information, from where we obtain the personal information and with whom we may share the personal information.

         Categories of person information we collect:

         We generally collect the following categories of Personal Information in providing our services:

  • identifiers such as a name, address, unique personal identifier, email, phone number, your device’s IP address software, and identification numbers associated with your devices;
  • characteristics of protected classifications under California or federal law, such as gender’
  • commercial information such as records of products or services purchased, obtained, or considered by you;
  • internet or other electronic information regarding your browsing history, search history, webpages visited, length of visit and number of page views, click stream data, locale preferences, your mobile carrier, date and time stamps associated with transactions, and system configuration information;
  • professional or employment-related information;
  • your geolocation, to the extent you have configured your device to permit us to collect such information; and
  • inferences about your preferences and characteristics.

         The reasons we collect personal information

         We collect Personal Information for the business purposes described in Sections 2 and 3 above.  The CCPA defines a “business purpose” as the use of Personal Information for the business’s operational purposes, or other notified purposes, provided the use of Personal Information is reasonably necessary and proportionate to achieve the operational purpose for which the Personal Information was collected or another operational purpose that is compatible with the context in which the Personal Information was collected.

         Sharing of Personal Information

         The categories of other individuals or entities with whom we may share your Personal Information are listed in Section 4 above.

         Your Privacy Rights Under the CCPA

As a consumer residing in California, you have the right to:

  • Know what Personal Information is being collected about you;
  • Access your Personal Information;
  • Know whether your Personal Information is sold or disclosed, and to whom;
  • Request a copy of the Personal Information collected about you during the twelve months prior to your request;
  • Request that your Personal information be deleted from our records; and
  • Receive equal service and prices, even if you exercise your privacy rights.

         Exercising Your Privacy Rights. 

We have disclosed above the categories of Personal Information we collect in the course of our business, and our use of the same. This is how you can exercise your privacy rights:

  • You may request that we disclose to you, free of charge, the Personal Information collected by us during the 12 months prior to your request, including the categories and specific pieces of that Personal Information, the sources from which we collected it, the purpose for collecting the information, and the categories of third parties with whom we have shared Personal Information. Your request for a copy of the Personal Information can be made only twice during the 12 month period.       
  • You may request that we delete from our records all Personal Information pertaining to you.
  • We must verify your identity before disclosing or deleting your Personal Information. We will promptly verify the request, respond to your verified request within 10 days, and disclose and deliver the requested information to you, or delete your information if requested, within 45 days after our receipt of your request.
  • You can make your request for disclosure or deletion of your Personal Information through the following channels:

 

  • If you believe you have been discriminated against or treated less favorably by us after exercising your privacy rights, you may notify us through the same channels.

         Your Ability to Opt Out of Notifications.

         Please note that you may no longer receive announcements, updates, or invitations to events if we delete your Personal Information. As an alternative to deletion, users may choose to opt out of our mailing lists by choosing the "unsubscribe” option in response to any promotional material they receive.  Users may also change their preferences by emailing privacy@mariniskinsolutions.com or by phoning or mailing us as indicated above.

         Limitations

         We will make good faith efforts to provide you with access to your Personal Information.  However, there may be circumstances where we are unable to provide access, including, without limitation, where the information would compromise the privacy of others, where the burden or expense of providing access would be disproportionate to the risk to the privacy rights in question, or where the information is commercially proprietary.  If we determine that access should be restricted for any reason, we will provide you with the reason for that determination as well as a contact person for any further discussion of the issue. 

         Do Not Track

         Do Not Track (DNT) is a privacy preference that users can set in certain web browsers.  DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services.  Please note that we do not recognize or respond to browser-initiated DNT signals.  For information about DNT, please visit hppts://allaboutdnt.com.

 

LINKS TO THIRD PARTY SERVICES

Our services may include links to other websites or third party services operated by other individuals or entities. For example, we provide links to our independent reseller affiliates to help direct consumers to MSS resellers. Such a link is not an endorsement of that third party and/or its services, nor does it permit, involve, or constitute the sharing of your personal information.  This Privacy Policy does not address the privacy practices of any third party, nor does it imply that any third party's privacy practices are covered by this Privacy Policy.  Other websites may follow different policies and practices regarding the collection, use, and disclosure of Personal Information. We recommend that you review and understand the privacy policies of any third party site before providing your Personal Information to them. We are not responsible for the information collection or privacy practices of others.

 

CHANGES TO THIS PRIVACY POLICY

We may modify this Policy from time to time. The effective date of the current Privacy Policy is noted at the top of the Policy.  We do not anticipate material changes to the way we collect, use, share, or process the personal information of consumers. However, we will inform you of any material changes that would adversely affect you by posting such material changes in a clear and conspicuous manner on our website.  Please note that your continued use of our site after we have posted changes to this Policy will constitute your agreement that the modified content of this Privacy Policy applies to your interactions with us.
